Order Terms and Conditions
These Order Terms and Conditions (“Terms”) govern the placement of orders (“Order”) with Waver Inc. (“we,” “us,” or “Waver Inc.”) for our products and related accessories (“Products”). By submitting an Order, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Order Placement
When placing an Order, you must provide accurate and up-to-date information, including billing and shipping details. You warrant the accuracy of this information and accept responsibility for keeping it current. Waver Inc. is not liable for delays or errors resulting from outdated or incorrect information. You may update your details prior to shipment by contacting sales@waverwifi.com.
We reserve the right to decline or delay Orders, including to prevent oversubscription. In such cases, we will notify you within two (2) weeks of receiving your Order, and you will be entitled to a full refund of the purchase price. Refunds will be processed within fourteen (14) days of notification. Actual refund times may vary depending on the customer’s payment provider.
2. Payment
The full price of the Products will be charged at the time you place your Order, unless otherwise stated on the order page. If Waver Inc. cannot ship the Products within one (1) month of your Order date, you will receive a full refund. Refunds will be issued to the original payment method. By placing an Order, you expressly authorize Waver Inc. to process payment immediately.
All payments are processed in USD. Customers are responsible for any currency conversion or international transaction fees imposed by their payment provider.
3. Priority
Orders are shipped on a first-come, first-served basis. Your position in the queue does not guarantee receipt of a specific Product serial number or identifier. Please refer to our website or newsletters for updates on shipping timelines.
4. Delivery Schedule
Delivery dates are estimates only and subject to change. Waver Inc. does not guarantee shipment by any specific date and is not liable for delays. Delays do not entitle you to discounts, refunds, or credits beyond what is expressly stated in these Terms. Customers are responsible for any applicable customs duties, import taxes, regulatory approvals, or compliance requirements in their respective jurisdictions. Waver Inc. is not responsible for delays caused by customs clearance procedures.
Waver Inc. is not liable for delays caused by circumstances beyond its reasonable control, including natural disasters, pandemics, supply chain disruptions, acts of carriers or logistics providers, or government regulations.
5. Pricing
The price for your Order is confirmed at the time of purchase and remains valid until the Product is delivered.
6. Returns
Products may be returned within fourteen (14) days of delivery, provided they are unused, in new condition, and returned in their original packaging. If you believe a Product is faulty, contact Waver Inc. within this period for troubleshooting and, if applicable, return authorization. Returns must comply with our Returns and Warranty Policy available on our website.
Return shipping costs are the responsibility of the customer unless the Product is confirmed to be defective upon inspection. This return policy applies to business purchases and does not limit any mandatory statutory consumer rights where applicable.
7. Limitation of Liability
To the maximum extent permitted by law, Waver Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from these Terms or your Order. Waver Inc.’s total aggregate liability for any claim shall not exceed the amount paid by you for the Product giving rise to the claim.
Waver Inc. acts as a distributor of the Products and does not manufacture the hardware or firmware. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.
8. Terms and Conditions of Sale
The purchase of Products is subject to additional terms, including software license terms, intellectual property terms, and data-related terms provided by the manufacturer or applicable licensors. These terms are available on our website or accompanying documentation and may be updated from time to time.
9. Age and Residency
By placing an Order, you confirm that you are at least eighteen (18) years old. Waver Inc. may limit service availability to specific geographic regions.
10. Customer Information
Information collected during the order process is handled in accordance with our Privacy Policy, Website Terms of Use, and applicable data protection laws, including the California Consumer Privacy Act (CCPA).
By placing an Order, you grant Waver Inc. permission to reference your company name, and where applicable your logo, in customer lists or portfolio materials, unless you opt out. This reference is for illustrative purposes only and does not imply endorsement or partnership. You may opt out by writing “OPT-OUT” in the order notes or contacting us directly. Upon request, we will promptly remove such references.
Under CCPA, you have the right to access, correct, or request deletion of personal information, subject to legal requirements. To exercise these rights, please contact dpo@waverwifi.com.
11. Amendments to Terms
Waver Inc. reserves the right to modify these Terms. Material changes will be communicated via email or a prominent notice on our website. Continued use constitutes acceptance of the updated Terms.
12. Miscellaneous Provisions

Entire Agreement: These Terms constitute the entire agreement between the parties regarding the subject matter herein and supersede all prior agreements or understandings.

Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Dispute Resolution: The parties agree to attempt to resolve any dispute arising out of or relating to these Terms through good-faith negotiation. If the dispute is not resolved, it shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) in accordance with its applicable rules.

Small Claims Exception: Either party may bring an individual claim in a court of competent jurisdiction for matters eligible for small claims court.

Non-Assignability: You may not assign or transfer these Terms, in whole or in part, without the prior written consent of Waver Inc., which shall not be unreasonably withheld.
13. Software and License Terms
Use of Products is subject to applicable end user license agreements (EULAs) and software terms provided by the manufacturer or applicable licensors. Failure to comply with such terms may result in limited functionality or termination of license rights.
